PROMOTIONAL CAMPAIGN REGULATIONS
“A NEW FACE WITH GAZIN!”
The Promotional Campaign “With a new look with Gazin!” is promoted by the company GAZIN SEMIJOIAS EIRELI-ME, established in the city of Limeira-SP, at Avenida Marechal Artur da Costa Silva no. Brazil, with the exception of the people described in item 3.2 below.
1. From the Promotional Campaign:
1.1 THE CAMPAIGN – This campaign is independent of any type of competition or competition, and is therefore not subject to the prior authorization established in art. 1st of Law No. 5,768/71.
2. Campaign Duration:
2.1 The Campaign will start on 02/01/2021 and is valid for the first 50 (fifty) purchases above the value of R$ 4,000.00 (four thousand reais), made through the platform online (WhatsApp) from Gazin.
3. Eligibility of Participants:
3.1 The Campaign is open to participants over 18 (eighteen) years of age.
3.2 Employees, managing partners and agents, as well as their respective relatives up to the second degree, including spouse and similar, of Gazin and its subsidiaries, as well as outsourced, temporary, freelancers who work on the premises of Gazin and its subsidiaries, even if not registered.
4. Participation in the Campaign:
4.1 Participation in the Campaign consists of: purchases above R$ 4,000.00 (four thousand reais) made through the platform online (WhatsApp) from Gazin, after due payment, the customer will receive a photo session with 05 (five) compositions of looks different, from various angles, produced and photographed by Gazin, with the pieces acquired by the customer in this purchase.
4.2 Purchases made by the customer during the campaign period cannot be added to receive the gift.
5. From Mechanics:
5.1 OF THE CAMPAIGN: as provided for in item 4.1, the customer who makes purchases above the value of R$ 4,000.00 (four thousand reais) through the platform online (WhatsApp) from Gazin, valid for the first 50 purchases, you will win a photo session with 05 (five) compositions of looks different, from various angles, produced and photographed by Gazin, with the pieces that the customer purchased in that purchase.
a) The customer will only acquire the right to the gift after clearing the purchase payment in the minimum amount of R$ 4,000.00 (four thousand reais).
b) It will be exclusively up to Gazin to choose the model who will pose for the photos, as well as the pieces and the composition of the 05 (five) looks to be produced and photographed.
5.2 By participating in the Campaign, the Participant will automatically agree to all the provisions and rules of these Regulations.
6. Delivery and use of the Promotional Campaign gift:
6.1 Gazin will have a period of 7 (seven) business days after confirmation of payment for the purchase to deliver the photos to the customer. The number of photos that will be sent to the customer will be defined by Gazin. What Gazin guarantees is the delivery of a photo session with 05 (five) compositions of looks different, produced with parts purchased by the customer.
a) The photos will be sent to the customer through a link, which will be available to the customer to make the download of the material, for a period of 7 (seven) calendar days from the date on which the customer receives the message via WhastApp informing that the link is now available for download.
b) The photos will be for the exclusive use of the customer, exclusively on their social networks (digital media), such as Facebook, Instagram, E-commerce and WhatsApp, and the use/dissemination of these photos in other advertising vehicles, such as printed media on billboards, magazines, newspapers and others, is expressly prohibited.
c) The client will have a non-extendable period of 06 (six) months, counting from the date the photos are made available through the link, to post the material on their social networks, as indicated in item “b” above. After this period, the customer will be prohibited from posting photos, whether in digital or printed media. The customer will not be obliged to delete photos already posted/disclosed on their digital media, if done within a period of 06 (six) months, as set out in this item.
d) Participation in the Campaign is voluntary and free access to all individuals or legal entities (customers) who purchase Gazin products in accordance with these Regulations, provided that all provisions of these Regulations are met.
6.2 Under no circumstances may the customer:
a) Request the gift in cash or other goods or services;
b) Exchange, negotiate, buy or sell the gift offered in this “Campaign”.
c) Interfere in the choice of parts and assembly of looks as well as the model who will pose for the photo shoot and the photos that will be sent via link.
d) Exigir o recebimento de um número mínimo de fotos.
6.3 As imagens presentes em todas as artes de veiculação da Campanha Promocional “De cara nova com a Gazin!” são meramente ilustrativas.
7. Direito autoral e direito de imagem:
7.1 Pertencerão exclusivamente à Gazin os direitos autorais das fotos que serão tiradas com as peças adquiridas pelo cliente.
7.2 Os Participantes concordam, desde já, em caráter irrevogável, em ceder, de forma irrevogável e irretratável, seus nomes, imagem e som de voz, para fins de divulgação da Campanha, sem qualquer ônus a Gazin, para utilização em toda e qualquer mídia (foto, áudio, vídeo, impresso, meios digitais, internet, celular, jornais e revistas, cartazes, folhetos, filmes, spots, peças publicitárias e e-mail), mas não se limitando a esses, pelo prazo de um ano contado da data de término da campanha, em todo o território nacional.
a) Os Dados Pessoais de titularidade do cliente, serão tratados visando a utilização na Campanha Publicitária mencionada acima, através da edição e diagramação de conteúdos de divulgação e marketing da Gazin, através de seus sites, redes sociais, revistas/publicações eletrônicas e quaisquer outros meios de comunicação digital, bem como em documentos físicos, através de panfletos, folders, banners, e outros meios de comunicação física de divulgação e propaganda, bem como em vídeos à serem exibidos nos circuitos internos de tvs, instalado nas dependências da Gazin e suas filiais, bem como em outros locais de interesse da Gazin.
b) Nesse sentido, o cliente declara-se ciente e autoriza a coleta e o tratamento de seus Dados Pessoais, mais especificamente suas imagens, voz, expressões, depoimentos e nome completo, para que tais dados sejam legalmente tratados, nos termos da Lei nº 13.709/2018 (LGPD – Lei Geral de Proteção de Dados), conforme as finalidades já previstas, nos termos do artigo 7º, inciso I, da referida norma, sem a necessidade de qualquer outra autorização e/ou aviso prévio para utilização desses dados nos referidos materiais e conteúdo. Este termo também cumpre a obrigatoriedade de autorização prevista no art. 20, da Lei nº 10.406/02, Código Civil Brasileiro.
c) O cliente declara-se ciente de que as informações acima foram por ele(a) fornecidas e são de sua inteira e total responsabilidade, especialmente quanto ao conteúdo e especificações. Declara-se ciente, ainda, de que seus dados permanecerão sob a responsabilidade da Gazin, sendo por ela armazenados e utilizados, posteriormente, na Campanha Publicitária já informada.
d) As Partes estão cientes de que a Gazin não poderá armazenar, modificar, utilizar e/ou repassar a terceiros, os Dados Pessoais do cliente para outras finalidades, senão para utilização na Campanha Publicitária definida.
d) A autorização objeto deste instrumento se dá de FORMA TOTALMENTE GRATUITA, para todos os conteúdos de divulgação, publicidade e marketing, relacionados a este Regulamento.
e) O cliente declara que a utilização de seus dados pessoais não lhe acarretará nenhum tipo de prejuízo, seja material ou moral, bem como de que está ciente de que a Gazin não poderá ser responsabilizada pelo uso indevido das imagens e dos demais dados pessoais, quando estes forem coletados por terceiros em exibições e/ou reproduções ocorridas de acordo com as especificações estabelecidas neste Regulamento.
8. Disposições Gerais:
8.1 O presente Regulamento encontra-se à disposição dos interessados também nas lojas físicas da Gazin.
